CONDITIONS APPLICABLE TO ALL YOUR ONLINE PURCHASES

 

ÉQUIPEMENTS ADAPTÉS MCL INC. (“MCL” or the “Store”) owns and operates a website at www.equipementsmcl.com and equipementsadaptesmcl.com (collectively, the “Site”).

 

Through its Site, MCL offers you the possibility of making certain online purchases. Before proceeding, please review the following terms and conditions, which form an integral part of any online order or purchase (collectively, the “Terms and Conditions”). By browsing the Site, you also agree to the following conditions. If you do not consent to these conditions, please do not consult the Site. Any consultation will be considered a full acceptance of all said Terms and Conditions, which are subject to change at any time and without prior notice.

 

  1. WHAT YOU NEED TO KNOW BEFORE PLACING YOUR ORDER

 

1.1      ACCURACY OF INFORMATION ON OUR WEBSITE

We take the necessary measures to ensure that the information and details provided on our website is up to date and accurate. However:

  • We cannot guarantee that the content of the website, including product descriptions or photographs thereof, is accurate, complete or entirely up to date at the time of your purchase;

  • We cannot guarantee that the products and services advertised on our website will be available when ordered online; and

  • It is possible that the price of a product or service listed on the website may change without notice.

In the event that errors should occur from time to time on our website, we will correct them as soon as they are identified. We invite you to notify us of any irregularities you may notice.

 

1.2      WARRANTY ON PRODUCTS

We honour the manufacturer’s warranties on the products we sell, subject to their conditions and specifications, and we also offer a one (1) year warranty on parts and related labour for any manufacturing defects, with the exception of batteries that have a limited warranty of six (6) months, starting from the date of possession (i.e., the date of delivery or the date of pick-up in store). Other limitations or reservations may apply, as may be specified when finalizing your online purchase. Please pay particular attention to any mention to this effect, especially on your final purchase order.

 

IMPORTANT : Warranties do not apply when there is misuse, negligence, abuse, excessive use or use that is contrary to the manufacturer’s recommendations.

NOTE: Photos of packaging and/or products may be required by MCL to confirm that a defect or malfunction is covered by the warranty.

1.3      CANCELLATION OF AN ORDER

It is possible to cancel your order as long as your request is made before we have shipped your order, and at the latest twenty-four (24) hours of your online purchase confirmation.

Fees may apply, especially if your order has been delivered in the meantime. If applicable, the amount of these fees will be communicated to you following the receipt of your cancellation request. You must not refuse delivery of your order under any circumstances, even if your cancellation request is being processed or has been accepted. If your cancellation request is accepted, you must strictly follow the instructions provided by the Store.

 

  1. CONDITIONS RELATED TO ORDERS

 

We only make deliveries in Canada. Some limitations may apply depending on your location.

 

2.1      PRODUCT AVAILABILITY

If your product is in stock, we will send you, by email, a shipping notification confirming that the product(s) you want to order are available.

Some products require an in-Store visit for their purchase. These products cannot be ordered from our website, especially for adapted products, in order to allow customers to test the product before purchasing it.

 

2.2      SHIPPING COSTS

Shipping costs vary depending on the destination and remain at your charge. The automated calculation presented on our website may differ from reality. In this case, we will contact you for any substantial or important discrepancy. At this stage of the transaction, you will be able to cancel your order if the shipping charges are not at your satisfaction.

 

2.3      TIME AND METHOD FOR SHIPPING AND DELIVERY

Orders will be typically shipped within 10 to 15 business days of the date of your order confirmation. In certain regions of Quebec, or in certain other places in Canada, the delivery time may be longer and may vary from one period of the year to another, particularly with regards to transportation demands that are beyond our control.

 

The shipping method and the choice of a shipping company are at our discretion and will be communicated to you upon confirmation of your order. Please note that delivery is made without signature collection.

 

If you wish to retain the services of another carrier, you must contact us at the coordinates mentioned in section 1.3 above, before confirming your online order. Any additional fees incurred by such a request will be at your charge.

 

2.4      CURRENCIES

Unless indicated otherwise, all prices displayed on our website are in Canadian dollars and exclude applicable taxes, such as consumption taxes (GST/QST or VAT). The calculation of applicable taxes displayed on the website is for indication purposes only, and may vary at the time of your order confirmation. After the confirmation of your order, and despite a tax collection indicated on the invoice, an additional charge may apply via the same online payment method in the event the amount of taxes collected does not correspond to the correct amount. Conversely, a credit may be issued if the amount of taxes collected is too high.

 

  1. RETURN POLICY

 

3.1      VERIFICATION OF YOUR ORDER AT THE TIME OF DELIVERY

It is your responsibility to check your order immediately upon receipt. It is important to keep all products in their original packaging in the event of a claim or a request for a refund or an exchange, when possible.

If you receive a defective or incorrect item, in the event of a delivery error or if you are not satisfied with a product, you can obtain a refund or credit by contacting us within three (3) days following the receipt of your order (see steps to follow in section 3.3 below). After this time, all products in your order will be considered entirely received, in good condition and fully accepted by you. Other specific limitations, reservations or exclusions may apply, as may be specified when finalizing your online purchase. Please pay particular attention to any mention to this effect, especially on your final purchase order.

 

IMPORTANT : the refund or the credit does not include shipping or delivery charges, and other charges at your expense, as prescribed in these Terms and Conditions.

 

NOTE : A 15% restocking fee may apply on returns.

 

3.2      NON-RETURNABLE PRODUCTS

The following products cannot be returned and will therefore not be exchanged, refunded or subject to credit:

  • identified as non-returnable on our website;

  • custom-made;

  • that are not in their original packaging, or that are damaged or soiled, or that are missing packaging, manuals, manufacturers documents or notices, accessories, parts, blank warranty cards or other similar items; and

  • all “personal protection” products;

  • all “sanitary” type products;

  • products similar to bedding, cushions or pillows;

  • used, worn, scratched, modified or damaged;

  • on clearance, on sale, or labeled “final sale”;

In addition, after our inspection in the days following receipt of your return package in accordance with the Terms and Conditions, the products considered to be no longer in a condition for sale will be considered non-returnable products. In such a case, you will be notified by email or a Customer Service agent will contact you regarding this matter.

The above-mentioned restrictions do not apply in cases where you return a product due to a malfunction or a defect covered by its warranty.

3.3      STEPS TO FOLLOW FOR A PRODUCT RETURN

 

  1. Contact Customer Service for your return code

To request a return or a claim of any kind, you must contact a Customer Service representative of the Store within 3 days of receiving your order, by telephone at 1 (450) 442-4111 or at 1-877-442-4111 (toll-free), or by email at Cette adresse e-mail est protégée contre les robots spammeurs.   1. Information to provide to Customer Service

You must provide the following information to Customer Service to proceed with a return request:

  • Invoice or shipment tracking number;

  • Payment method and related information, if necessary;

  • Product code and quantity; and

  • The reason or motive for the return;

  • Your full-contact information, including a reference email address;

  • Any other relevant information required by Customer Service;

NOTE : Photos of packaging and/or products may be required to obtain a return authorization number.

 

  1. Product Return

Once the request has been processed and authorized, you will receive a return authorization number by email, which you will need to print and add to the product you wish to return.

IMPORTANT : no returned product will be accepted without a valid return authorization code included in the return package.

 

  1. Product Return Fees

 

  • The return will be at our expense in the event of a shipping error on our part or if you have received a defective, damaged or expired product, which will be confirmed during the return inspection mentioned in section 3.2 above;

  • The return will be at your expense in the event of an error on your part, if the product does not suit your needs, or if the product could not be subject to a return in accordance with section 3.2 above;

 

  1. Credit Issuance, Exchange or Refund

 

Once we have received and verified the returned product, and determined that the product is in a resalable condition as specified above, a credit, refund or exchange will be issued to you as confirmed by our Customer Service during the return process.  Please note that in the event that we determine that the product is not in a resalable condition, it will be returned to you as long as you assume the shipping costs of the product.

 

NOTE : In the event of an exchange, the shipping costs incurred in order to send you a product replacement will be handled in the same manner as in section D above.

 

  1. CONFIDENTIALITY AND SECURITY OF PAYMENTS

 

4.1      CONFIDENTIALITY

We comply in our activities with the following confidentiality laws: The Privacy Act (R.S.C., 1985, Chap. P-21); the Personal Information Protection and Electronic Documents Act (S.C., 2000, Chap. 5); and the Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1).

 

You can browse our website anonymously. However, to order products from our website, you must enter personal information. We use this information to create your account, to communicate and correspond with you about your order, and to respond to your requests. The information requested is limited to: identification of the purchaser (first and last name, if an individual), shipping, delivery and billing addresses, telephone number and information necessary for any payment made by credit card (cardholder name, expiration date and credit card number). You may notify us at any time that you wish to withdraw or change your consent with respect to the use of this information. We do not store our customer’s credit card information. Once the transaction is completed, you will be redirected to the Global Payments secured site to proceed with online payment.

 

Under no circumstances do we give, sell, or market your personal information. We use your data only for administrative purposes, such as for responding to orders, for invoicing, for delivery, or to ensure appropriate follow-ups in the event of a recall or other communications between you and the manufacturer to facilitate compliance with warranties on the product purchased or to notify you of a product recall required by Health Canada or by the manufacturer.

 

4.2      SECURITY OF ONLINE PAYMENTS

All payments made by credit or debit cards are transmitted to Global Payments, which has its own privacy policies regarding the protection of personal information, as well as encryption methods to ensure the security of transactions.
